An Act to render null and void certain unconstitutional laws enacted by the Congress of the United States, taking control over the health insurance industry and mandating that individuals purchase health insurance under threat of penalty.
SECTION 1. The legislature of the State of ____________ finds that:
1. The People of the several states comprising the United States of America created the federal government to be their agent for certain enumerated purposes, and nothing more.
2. The Tenth Amendment to the United States Constitution defines the total scope of federal power as being that which has been delegated by the people of the several states to the federal government, and all power not delegated to the federal government in the Constitution of the United States is reserved to the states respectively, or to the people themselves.
3. The assumption of power that the federal government has made by enacting the “Patient Protection and Affordable Care Act” interferes with the right of the People of the State of _____________ to regulate health care as they see fit, and makes a mockery of James Madison’s assurance in Federalist #45 that the “powers delegated” to the Federal Government are “few and defined”, while those of the States are “numerous and indefinite.”
SECTION 2. NEW LAW
A new section of law to be codified in the [STATE] Statutes as Section [NUMBER] of Title [NUMBER], unless there is created a duplication in numbering, reads as follows:
A. The Legislature of the State of _______________ declares that the federal law known as the “Patient Protection and Affordable Care Act,” signed by President Barack Obama on March 23, 2010, is not authorized by the Constitution of the United States and violates its true meaning and intent as given by the Founders and Ratifiers, and is hereby declared to be invalid in this state, shall not be recognized by this state, is specifically rejected by this state, and shall be considered null and void and of no effect in this state.
B. It shall be the duty of the legislature of this State to adopt and enact any and all measures as may be necessary to prevent the enforcement of the “Patient Protection and Affordable Care Act” within the limits of this State.
C. Any official, agent, or employee of the United States government or any employee of a corporation providing services to the United States government that enforces or attempts to enforce an act, order, law, statute, rule or regulation of the government of the United States in violation of this act shall be guilty of a felony and upon conviction must be punished by a fine not exceeding five thousand dollars ($5,000.00), or a term of imprisonment not exceeding five (5) years, or both.
D. Any public officer or employee of the State of ____________ that enforces or attempts to enforce an act, order, law, statute, rule or regulation of the government of the United States in violation of this act shall be guilty of a misdemeanor punishable by imprisonment in the county jail not exceeding two (2) years or by a fine not exceeding One Thousand Dollars ($1,000.00) or both such fine and imprisonment.
E. Any aggrieved party shall also have a private action against any person violating the provisions of subsections (C) or (D).
SECTION 3. This act takes effect upon approval by the Governor.

The fact that you are against the Affordable Care Act tells me that you have never been disastrously Ill and have never had a loved one become terribly sick. If you had you’d be all for reform.
My girl has been sick for 16 years. With the best state insurance, we still had to go bankrupt. Waiting times at our ER are 8 hours average.
People against obamacare are against the health of all Americans.
Reform is reform. obama care is bullshit, and unconstitutional. If you would see past us “not caring” or “not having sick family members” then you might see that we do want reform, just not something mandated by a tyrannical government.
“People against obamacare are against the health of all Americans.”
wow…
Coming from an officer in the Air Force, maybe you were brainwashed.
Does that mean that if I am against the department of education, I am against children being taught in schools?
Pull your head out.
Try not to think of us as attacking that which you love, but maybe protecting you from lies.
I cant even continue anymore, there may be no hope for you until the end when the plans of the elite come together.
First, the majority of people who oppose “Obamacare” are against it because it is a tax. In an economy as fragile as ours is currently, the last thing the people need is the federal government taking more money out of our pockets. The middle class is already dwindling at unprecedented rates and they will bear the brunt of this tax financially.
Second, why should the federal government even have its hands in healthcare? Let’s consider the obvious track record here. Social Security – Broke, Post Office – Broke, Medicare – Broke, Medicaid – Broke, Amtrak – Broke. When the federal government takes control of anything, they have this uncanny ability to drive costs through the roof and by doing so it comes crashing back down on the people in forms of higher taxation. That is one of the reasons why PPACA was created in the first place. It is a revenue/taxation machine for the federal government. Now, do you think that revenue will be put back into the healthcare system or will it be spent on other interests like unconstitutional wars and programs that run guns into mexico? If the federal government was known for appropriately managing funds paid by the people, Social Security wouldn’t be slated to run out of money by 2026.
Let’s consider something else here. You mentioned that you have had “the best” healthcare insurance and it bankrupted you. You also said that your average ER wait time was 8 hours average. So how will PPACA remedy those two qualms? By having “the best” healthcare insurance, you think a federal government subsidized healthcare insurance will be better? And now with “everyone” insured, wouldn’t that mean more people will be going to the ER and increasing wait times? People already take advantage of emergency care because they cannot refuse service, imagine when everyone is “insured”, you will probably see emergency room visits for papercuts. Why not, I’m insured now.
“Obamacare” states that insurers must justify rate hikes. Let me justify the first one right now for you. Insuring 30 million more people will definitely mean that health systems need to increase their staff, which means higher costs, which will justify increasing margins. Did you know Obamacare will appropriate funding for increasing the IRS workforce by 16,000 jobs yet there is nothing in the bill that appropriates funding to increase healthcare staffing?
And before you jump to conclusions about what other people have been through in their life, let me tell you a true story…
I have a rare skin disease called Hidradenitis Suppurativa (HS). This disease is so severe that it is listed on the Social Security Disabilities “Blue Book” Section 8 Subsection 6 as an automatic inclusion into the Social Security Disability program and I ABSOLUTELY OPPOSE PPACA.
1. It’s only a “tax” if you don’t have insurance in which case you are “taxing” all those who have to pay for you which is what’s not fair. The Affordable Care Act fixes that.
2. The government needs to step in because it’s obvious to anyone that insurance companies could care less.
3. Actually, I don’t have to win this argument at all. As soon as you, or someone close to you gets seriously ill…you’ll be on my side.
Just wait.
